Terms and Conditions
Last updated: 23 October 2026
1. Introduction
Welcome to SamSam South Africa (“SamSam”, “we”, “us” or “our”). These Terms and Conditions govern your use of our website, https://samsam.co.za, and the information and services presented through it.
By accessing or using this website, you agree to these Terms and Conditions. If you do not agree, please discontinue use of the website.
2. Our Services
SamSam provides solar energy solutions and related electrical services, which may include solar panel system design and installation, inverters and battery storage systems, electrical installations and upgrades, solar system assessments and consultations, energy solutions for residential and commercial properties, and related maintenance and support services.
The availability and scope of services depend on the project, location, technical requirements and any separate agreement.
3. Website Information and Accuracy
We aim to ensure that the information on our website is accurate and up to date. However, product specifications, pricing, promotions, estimated savings and technical information may change without notice.
Website content is provided for general information and should not be treated as a final technical design, engineering assessment or installation quotation.
Although we take reasonable care when preparing website content, we do not guarantee that all information will always be complete, accurate or current.
4. Quotations and Pricing
Any prices, promotions, savings estimates or example system configurations displayed on our website are indicative unless expressly stated otherwise.
A final quotation may depend on factors including the property's electrical infrastructure and roof structure, electricity consumption and energy requirements, equipment availability and manufacturer specifications, installation complexity and site conditions, applicable municipal requirements and approvals, and changes in supplier pricing or project scope.
A quotation will be subject to its stated validity period, scope, exclusions and payment terms. Work will be governed by the accepted quotation, service agreement or other applicable contractual documents.
No website enquiry or request for a quotation obliges either party to proceed with a project.
5. Solar Design and Estimated Savings
Solar system designs, simulations, energy forecasts and estimated savings are based on the information available at the time of assessment.
Actual system performance may vary due to weather, shading, equipment configuration, electricity consumption, grid availability, battery settings, tariffs and other factors.
Any estimated savings or projected energy production are not guarantees of future performance or financial returns.
Where we use building plans, electricity bills, photographs or other information supplied by a client, the accuracy of the resulting design depends partly on the accuracy and completeness of that information.
Final equipment selection and installation must take account of actual site conditions and applicable technical requirements.
6. Equipment, Manufacturers and Warranties
Solar panels, inverters, batteries and other equipment may be subject to separate manufacturer warranties and warranty conditions.
Unless expressly stated in a written agreement, SamSam does not provide any additional manufacturer warranty beyond the warranty or service commitments specifically agreed with the customer.
Warranty coverage may depend on correct installation, product registration, maintenance, operating conditions and compliance with the manufacturer's requirements.
Customers should retain relevant invoices, warranty documents and equipment information.
Nothing in these Terms and Conditions excludes any consumer rights or legal warranties that cannot lawfully be excluded under South African law.
7. Installation and Site Requirements
Installation work is subject to an agreed project scope, suitable site access, applicable safety requirements and any necessary permissions or approvals.
Customers may be required to provide accurate property information, access to the installation area and relevant electrical documentation.
Additional work may be necessary if site conditions differ from those originally assessed. Any material changes to the project scope, price or installation schedule should be agreed with the customer before the additional work proceeds, except where urgent action is reasonably necessary for safety or required by law.
Installation dates may be affected by weather, equipment availability, access restrictions, inspections, municipal processes and other circumstances outside our reasonable control.
8. Electrical Compliance and Approvals
Electrical and solar installations must comply with applicable South African laws, regulations, technical standards and relevant municipal requirements.
Where required, certificates, test results, applications or other compliance documentation will be addressed in accordance with the agreed project scope and applicable legal requirements.
Municipal approval, grid connection permission, registration or authorisation is not guaranteed merely because a system has been designed, quoted or installed.
The customer remains responsible for any property-owner obligations or permissions assigned to them under applicable law or the project agreement.
9. Payments, Cancellations and Refunds
Payment schedules, deposits, cancellation terms, refunds and any applicable fees will be set out in the accepted quotation or service agreement.
Customers should review these terms before accepting a quotation or making a payment.
Any cancellation charges or deductions must be consistent with the applicable agreement and South African law. Where the Consumer Protection Act 68 of 2008 applies, statutory consumer rights will remain unaffected.
Nothing in these Terms and Conditions is intended to remove a right to cancel, receive a refund or obtain another remedy where that right is provided by law.
10. Website Enquiries and Communications
Submitting a contact form, requesting a quotation or contacting SamSam through this website does not automatically establish a contractual relationship.
You agree to provide information that is accurate and not misleading when submitting an enquiry.
We may contact you using the contact details you provide to respond to your enquiry, discuss a potential project or provide information you have requested, subject to applicable privacy and electronic communications laws.
Marketing communications will be handled in accordance with applicable law.
11. Privacy and Personal Information
We respect your privacy and process personal information in accordance with applicable South African data protection legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA), where applicable.
Our Privacy Policy explains what information we collect, why we collect it, how it may be used and how you can exercise your applicable rights.
Please review our Privacy Policy on this website for further information.
12. Intellectual Property
Unless otherwise indicated, the content on this website, including text, graphics, branding, designs, photographs, videos and other materials, belongs to SamSam or is used with permission.
You may view and use the website for personal, informational or legitimate business purposes.
You may not reproduce, distribute, modify, publish or commercially exploit website content without the necessary permission, except where permitted by law.
Product names, logos and trademarks belonging to manufacturers or other third parties remain the property of their respective owners.
13. Third-Party Websites and Products
Our website may refer to third-party manufacturers, suppliers, software platforms or external websites.
These third parties operate independently of SamSam. We are not responsible for the content, availability, privacy practices or terms of external websites that we do not control.
Any purchase, warranty or service provided directly by a third party may be governed by that party's own terms and conditions.
14. Acceptable Use
You may not use this website to engage in unlawful, fraudulent or misleading activities, attempt to gain unauthorised access to our website, systems or data, introduce malicious software or interfere with website security, copy or misuse website content in violation of applicable rights, or submit false, abusive or harmful information through our forms.
We may take reasonable steps to protect our website and users against misuse, subject to applicable law.
15. Limitation of Liability
To the extent permitted by South African law, SamSam will not be liable for losses arising solely from reliance on general website information, indicative savings estimates, temporary website interruptions or third-party websites beyond our reasonable control.
Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful, including applicable liability for negligence, breach of contract or consumer rights that cannot lawfully be excluded.
Any liability relating to a specific installation or service will also be governed by the applicable quotation, service agreement and relevant law.
16. Events Outside Our Reasonable Control
We will not be responsible for delays caused by circumstances beyond our reasonable control, which may include severe weather, supply-chain disruptions, power outages, transport interruptions, regulatory delays or other unforeseen events.
We will take reasonable steps to communicate material delays and, where appropriate, discuss revised arrangements with the customer.
This clause does not remove any rights or obligations imposed by applicable law.
17. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our services, website or legal obligations.
The updated version will be published on this page with a revised date. Changes will apply subject to applicable law and will not retrospectively alter an existing agreement where doing so would be unlawful.
18. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Any dispute will be handled by a court or other dispute-resolution body with appropriate jurisdiction, subject to applicable law and any valid agreement between the parties.
